   These General Terms and Conditions of Sale (hereinafter "GTC") are concluded between the company ROUSSEUR COLLECTION, a single-member simplified joint-stock company, registered with the Paris Trade and Companies Register under number 980 233 720, whose registered office is located at 96 rue des Entrepreneurs, 75015 Paris (hereinafter "ROUSSEUR"), and any consumer, natural person, who visits or places an order via the Site (hereinafter "the Customer").

ROUSSEUR COLLECTION allows the Customer to order ROUSSEUR brand products online (hereinafter "the Product(s)") subject to acceptance of these General Terms and Conditions. Any order placed on the Site implies the Customer's unreserved acceptance of these General Terms and Conditions. ROUSSEUR COLLECTION reserves the right to modify them at any time; the applicable General Terms and Conditions are those in effect on the Site at the time of the order.

2. Definitions

• Customer : means any natural person placing an Order for Product(s) on the Website.
• Site : means the merchant site accessible at the address https://rousseurcollection.com/ .
• Product(s) : means the items offered for sale on the Site.
• Order : means any request to purchase Product(s) by the Customer on the Site.

3. General information
The Products sold on the Site by ROUSSEUR COLLECTION are intended exclusively for personal, non-commercial use. Any resale or professional use is prohibited without prior authorization. Professionals can contact the sales department for specific conditions adapted to their activity.

ROUSSEUR COLLECTION reserves the right to request information from the Customer to verify their consumer status and to refuse any Order deemed abnormal in terms of quantity or frequency.

4. Products
The products available on the Site are described and presented with the greatest precision. However, minor differences, particularly in color, may appear depending on the technical characteristics of the screens and browsers used.

Products include scented candles, room diffusers, and vases, all made in Europe by skilled artisans. Details of the product's composition, precautions for use, and care recommendations are available in the product sheets on the Site.

Photographs and descriptions are provided for informational purposes only and have no contractual value. ROUSSEUR COLLECTION cannot be held responsible for slight variations between the presentation of the Products on the Site and the Products delivered. The availability of the Products is guaranteed within the limits of stocks; in the event of a shortage, ROUSSEUR COLLECTION undertakes to inform the Customer as soon as possible to offer an alternative solution or a refund.

5. Price
Prices are indicated in euros (€), all taxes included (TTC), excluding delivery costs, which are specified before validation of the Order. ROUSSEUR COLLECTION reserves the right to modify its prices at any time, without notice. Products are invoiced at the rate in effect at the time of validation of the Order.

6. Order
To place an Order, the Customer selects the desired Products and follows the validation steps on the Site. Before finalizing the Order, the Customer can check the details and correct any errors. The Order becomes final upon receipt of full payment. A confirmation email is then sent to the Customer. ROUSSEUR COLLECTION reserves the right to refuse any Order for legitimate reasons.

7. Availability of Products
Product offers are valid as long as they are visible on the Site and available in stock. In the event of unavailability after validation of the Order, the Customer will be informed by email and will be able to obtain a refund for the unavailable Product within 14 days.

Certain categories of Products, rare or exclusive, may be subject to quantity limitations per Order. ROUSSEUR COLLECTION also reserves the right to refuse an Order exceeding these limits.

8. Payment
The Customer can pay for their Order directly on the Site using one of the secure payment methods offered by ROUSSEUR COLLECTION, in particular by bank card via Stripe or via PayPal.

When ordering, the Customer can also benefit from discounts or special offers thanks to a valid Promo Code. To activate it, simply enter the Promo Code in the field titled "I have a promo code" and click "OK" to have the benefit applied to the total order.

The Customer guarantees that he or she has the necessary authorizations to use the chosen payment method. ROUSSEUR COLLECTION takes all measures to guarantee the security and confidentiality of data transmitted during transactions, this information being processed directly by the banking service provider and not stored by the Site.

9. Delivery
The Products are delivered to the address provided by the Customer when ordering. ROUSSEUR COLLECTION entrusts shipping to external transport providers.

In the event of a failed delivery, the package will be returned to ROUSSEUR COLLECTION, and a refund will be issued within 15 days of receipt of the return. If the Customer refuses delivery, the package will also be returned, and a refund will be processed, less the delivery costs, which remain the responsibility of the Customer.

ROUSSEUR COLLECTION cannot be held responsible for delivery delays or errors caused by carriers. However, if ROUSSEUR COLLECTION is directly liable, it may be released by proving that the non-performance is due either to the Customer, a third party, or a case of force majeure.

10. Right of withdrawal
In accordance with legal provisions, the Customer has 14 days from receipt of the Products to exercise his right of withdrawal without justification.

To do this, simply notify ROUSSEUR COLLECTION by email at the following address : rousseurcollection@gmail.com , or via the withdrawal form available on the Site. Returned Products must be in perfect condition, unused, and in their original packaging, within 14 days of notification of withdrawal. Return costs are the responsibility of the Customer. ROUSSEUR COLLECTION will refund the amount of the Products (excluding delivery costs) within 14 days of receipt of the returns.

11. Returns and Refunds
If the Customer receives a defective Product or one that does not conform to the Order, they have 7 days to contact ROUSSEUR COLLECTION. The return, replacement, or refund will be arranged at the Customer's discretion. Refunds will be made using the same payment method within 14 days of receiving the returned product.

12. Guarantees
The Products are covered by the legal guarantee of conformity and against hidden defects. In accordance with Articles L217-4 et seq. of the Consumer Code and Articles 1641 et seq. of the Civil Code, in the event of a defect, the Customer may request repair or replacement. This guarantee of conformity is valid for 2 years from delivery.

13. Liability
ROUSSEUR COLLECTION declines all liability in the event of delay or failure caused by force majeure. Furthermore, ROUSSEUR COLLECTION shall not be held liable in the event of negligence or misuse of the Products by the Customer, nor for indirect damages. In any event, ROUSSEUR COLLECTION's liability is limited to the total amount of the Order.

14. Intellectual Property
The intellectual property rights relating to the Site, trademarks, logos, and other content (images, texts, graphics) belong exclusively to ROUSSEUR COLLECTION or their respective owners. The Customer undertakes to respect these rights and to use them only for personal use of the Products. Any violation of ROUSSEUR COLLECTION's intellectual property rights is prohibited.

15. Personal data
ROUSSEUR COLLECTION is committed to complying with current regulations on the protection of personal data (GDPR). The information collected on the Site is used for processing orders and managing commercial relations. The Customer may exercise their right to access, rectify or delete their data by contacting ROUSSEUR COLLECTION at rousseurcollection@gmail.com .

16. Disputes
These General Terms and Conditions are governed by French law. In the event of a dispute, an amicable solution will first be sought. Failing agreement, the dispute will be brought before the competent courts of the defendant's place of residence or the place of delivery.

17. Amendments to the T&Cs
ROUSSEUR COLLECTION reserves the right to modify these General Terms and Conditions at any time. The applicable General Terms and Conditions are those in effect at the time of the Order, published on the Website.

18. Acceptance of the general conditions by the customer

The Customer acknowledges having carefully read these General Conditions. By registering on the Site, the Customer confirms having read and accepted the General Conditions, making them contractually bound by the terms of these General Conditions.
